Terms & Conditions

Version 1.1 · Effective 18 October 2026

1. About these Terms

These Terms & Conditions govern your use of MomentDrops and the purchase and use of a MomentDrops event package.

MomentDrops is operated by MOMENTDROPS (PTY) LTD, a private company incorporated in South Africa under registration number 2026/693581/07 ("MomentDrops", "we", "us" or "our").

Registered office: 20 Lupin Crescent, Milnerton, Cape Town, Western Cape, 7441, South Africa.

Website: momentdrops.com

Support email: hello@momentdrops.com

By creating an account, purchasing a package or otherwise using MomentDrops, you agree to these Terms and our Privacy Notice. If you do not agree, you should not use the service.

Nothing in these Terms excludes or limits any consumer right that may not lawfully be excluded under South African law.

2. What MomentDrops provides

MomentDrops is a digital wedding-media collection service.

An account holder creates a wedding event and receives a unique event link and QR code. Guests can use that link or QR code to upload photographs and, where included in the purchased package, video clips.

Guests do not need to create a MomentDrops account to upload media.

Uploaded media is collected into a private gallery accessible to the account holder for that event. Guests do not receive access to browse or download the private couple gallery merely because they have the event link or QR code.

MomentDrops is a media collection and storage service. It is not a professional photography or videography service and does not replace a wedding photographer, videographer or other professional supplier.

3. Your account

You must have the legal capacity to enter into a binding agreement to create an account and purchase a MomentDrops package.

You must provide accurate information when creating your account and event.

You are responsible for keeping your password and account access secure. Please contact us promptly if you believe your account has been accessed without permission.

Your MomentDrops account is personal to you and should not be sold, transferred or made available to another person without our consent.

You may create and manage wedding events through your account subject to the features available at the time.

4. Your event

You are responsible for providing accurate event information, particularly your wedding date.

The wedding date is important because package periods, including gallery retention, may be calculated from that date.

Where MomentDrops permits you to choose an upload-opening date, the opening and closing dates displayed for your event will determine when guests may upload.

The service currently permits an upload period associated with the wedding event. The exact upload period applicable to your purchase will be shown in the package information and your event dashboard.

You are responsible for distributing your QR code or event link only to people you reasonably intend to invite to contribute to the event.

Possession of a valid event QR code or guest link is sufficient to access the guest-upload experience during the active upload period. MomentDrops does not independently verify that every person using a valid event link physically attended the wedding.

5. Packages

MomentDrops packages may differ according to factors including:

  • photos permitted;
  • video availability;
  • storage allowance;
  • maximum video duration or file size;
  • suggested wedding or guest size;
  • upload period; and
  • gallery-retention period; and
  • recovery period.

The package description displayed before payment forms part of your agreement with us.

The package, price and features shown on the checkout page at the time you place your order are the package and price that apply to that purchase.

MomentDrops may change packages or pricing for future purchases. A later price change will not retrospectively increase the price of a package you have already paid for.

There are no recurring subscription charges unless you expressly purchase a separate service that clearly states otherwise.

6. Storage allowances

Each package includes a defined storage allowance.

Photos and videos uploaded to your event count towards that allowance.

MomentDrops may warn you as your event approaches its storage limit.

If the purchased allowance is exhausted, further uploads may be prevented until additional capacity is arranged where available.

Guest-count figures displayed with packages are guidelines intended to help couples choose a suitable package. They are not individual guest-upload quotas.

MomentDrops may take reasonable steps to protect the service against misuse, automated abuse or unusually excessive activity that threatens the availability or security of an event or the platform.

7. Supported media

MomentDrops supports the photo and video formats identified in the guest-upload interface and Help Centre.

Files remain subject to technical limits such as supported file type, file size, video duration and the remaining event storage allowance.

MomentDrops may reject files that are corrupted, unsupported, exceed the applicable limits or appear technically unsafe.

Where possible, original uploaded media is preserved for the account holder to download.

MomentDrops may generate smaller or otherwise optimised versions for previews and gallery performance. The preview displayed in the gallery may therefore differ in size or quality from the downloadable original.

8. Guest uploads

Guests may be given the option to provide a name when uploading media. Providing a guest name is optional unless MomentDrops expressly states otherwise.

A guest who uploads media is responsible for the material they choose to submit.

Guests must not knowingly upload material that is unlawful, malicious, abusive, defamatory, seriously invasive of another person's privacy, infringes intellectual-property rights, contains malware, or is otherwise prohibited by law.

MomentDrops does not routinely pre-screen every photograph or video before it reaches the private gallery.

We may remove, restrict or preserve access to content where reasonably necessary to respond to a lawful request, protect users or the platform, investigate abuse, comply with law or enforce these Terms.

9. Rights in photographs and videos

MomentDrops does not claim ownership of photographs or videos uploaded to an event.

Copyright and other rights remain with the person or persons who own those rights.

By uploading media, the uploader grants MomentDrops a limited, non-exclusive licence to receive, store, copy, process, create technical previews or derivatives, back up, restore and deliver that media only to the extent reasonably necessary to provide, secure, support and administer the MomentDrops service or comply with law.

MomentDrops does not obtain the right to sell guest wedding photographs merely because they were uploaded to the platform.

MomentDrops will not make private wedding media publicly available for advertising or marketing without appropriate permission.

10. The private gallery

The couple/account holder's gallery is private by default.

Access controls are intended to prevent one MomentDrops customer from accessing another customer's gallery.

Guests who upload through a guest link do not automatically receive access to browse the couple's private media.

The account holder may download all media or selected media using the functionality available in their package or dashboard.

You should download and securely back up the media you wish to keep before the applicable retention period expires.

11. Deleting media

The account holder may be permitted to permanently delete unwanted photographs and videos from their gallery.

You should treat a permanent deletion action as irreversible.

MomentDrops may use appropriate confirmation steps before carrying out destructive actions.

Where technical backup copies exist, deletion from backups may occur through the applicable secure deletion process rather than instantaneously across every backup system.

Legal, security, fraud or regulatory obligations may require MomentDrops to retain limited records even after other information has been deleted.

12. Gallery retention and expiry

Your purchased package includes a defined gallery-retention period.

Unless otherwise expressly stated at checkout, the applicable retention period is calculated from the wedding date recorded for the event.

Your dashboard and package information should be consulted for the specific retention period that applies to your event.

MomentDrops may provide a recovery or grace period after normal gallery access expires. During that period, access may be restricted.

Where MomentDrops offers additional recovery time or an extension, this may involve an additional charge based on factors such as the package, storage consumed and additional period requested.

An extension is not automatic unless it is expressly purchased or confirmed by MomentDrops.

After the applicable retention and recovery periods have expired, media may be permanently deleted and may no longer be recoverable.

You are responsible for downloading the wedding media you wish to retain before the final deletion deadline shown to you.

13. Payments

MomentDrops packages are generally purchased through a once-off payment.

The total amount payable will be displayed before you confirm the transaction.

Payments are processed through an external payment provider, currently PayFast.

MomentDrops does not receive or store your complete bank-card details.

A package is treated as paid only once MomentDrops has received and verified appropriate confirmation of successful payment.

If a payment is declined, cancelled, reversed, disputed or cannot be verified, the relevant paid features may remain unavailable until the payment position has been resolved.

14. Cancellations and refunds

You may request cancellation by contacting MomentDrops.

Nothing in this clause removes a cancellation, cooling-off, refund or other consumer right provided to you by applicable South African law.

As a MomentDrops customer-service policy, if you request cancellation within seven days after purchasing your package and the service has not been materially used, MomentDrops will generally provide a full refund.

If you cancel after that period, or after substantial use of the service has begun, MomentDrops may apply a reasonable cancellation charge where permitted by law.

In determining a reasonable cancellation amount, we may consider the nature of the service, notice provided, services already supplied, resources consumed and other relevant circumstances.

If MomentDrops is unable to provide the purchased service because of a failure attributable to us, we will provide an appropriate remedy in accordance with the circumstances and applicable law. This may include correcting the service, extending access, issuing credit or refunding an appropriate amount.

Nothing in these Terms limits any right or remedy that cannot lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African law.

15. Internet connection and guest participation

MomentDrops depends on internet connectivity.

Guest uploads may be affected by venue Wi-Fi, mobile-network coverage, device restrictions, browser behaviour, battery availability, file size or other factors outside MomentDrops' direct control.

MomentDrops cannot guarantee that every wedding guest will scan the QR code, upload photographs, upload all photographs taken or otherwise participate in the service.

The number, quality and content of photographs or videos submitted by guests therefore cannot be guaranteed.

If an upload fails, guests should follow any retry or resume options presented by the service.

16. Service availability

We aim to operate MomentDrops reliably and securely.

However, no internet-based service can reasonably guarantee uninterrupted availability at every moment.

Maintenance, third-party infrastructure problems, telecommunications failures, security incidents or circumstances beyond reasonable control may temporarily affect the service.

MomentDrops will take reasonable steps to restore affected services and protect uploaded information.

Nothing in this section excuses MomentDrops from obligations that may not lawfully be excluded.

17. Backups and protection of wedding media

MomentDrops treats wedding media as important customer data and may maintain technical safeguards, redundancy and backup processes intended to reduce the risk of loss.

Backups are a risk-reduction measure and do not constitute a guarantee that data loss can never occur under any conceivable circumstance.

Customers should maintain their own copy of all media they wish to preserve permanently once the gallery is available for download.

MomentDrops' Privacy Notice explains the security safeguards and processing practices applying to personal information.

18. Privacy

MomentDrops processes personal information in accordance with its Privacy Notice and applicable South African data-protection law, including the Protection of Personal Information Act 4 of 2013 ("POPIA").

The Privacy Notice explains information collected about account holders, events and guest uploads; how it is used; service providers involved; security measures; retention; international processing where applicable; and how data subjects may exercise their rights.

19. Third-party providers

MomentDrops relies on third-party providers for parts of its service, which may include hosting, database services, storage, email delivery, payment processing, infrastructure and backup services.

Those providers may process information in accordance with their applicable terms, privacy arrangements and our agreements with them.

MomentDrops remains responsible for its own legal obligations regarding its selection and use of service providers.

20. Acceptable use and security

You must not attempt to:

  • gain unauthorised access to another user's event, account or media;
  • circumvent access controls or package restrictions;
  • interfere with the operation or security of the platform;
  • introduce malware or malicious code;
  • automate abusive uploads or requests;
  • probe or exploit vulnerabilities without permission; or
  • use MomentDrops to facilitate unlawful activity.

We may restrict or suspend access where reasonably necessary to secure the platform, investigate suspected abuse or comply with law.

21. Intellectual property in MomentDrops

MomentDrops and its underlying software, brand, designs, website content, logos, interface and other proprietary materials belong to MomentDrops or its applicable licensors.

Your right to use the service does not transfer ownership of those materials to you.

This clause does not apply to wedding photographs or videos uploaded by users, which are addressed separately above.

22. Important limitations

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability that applicable law prohibits a supplier from excluding.

Subject to those rights, MomentDrops is not responsible for losses caused solely by circumstances genuinely outside its reasonable control, such as a guest deciding not to participate, a guest deleting photographs from their own device before uploading them, failure of a guest's internet connection or incorrect event information supplied by the customer.

MomentDrops will not attempt through these Terms to exclude liability for gross negligence where such exclusion is prohibited.

23. Complaints and support

If something goes wrong, we encourage you to contact MomentDrops first so that we can investigate and try to resolve it.

Email: hello@momentdrops.com

Nothing in this process prevents a consumer from exercising any statutory right or approaching an appropriate regulator, tribunal, ombud, court or other body where applicable.

24. Changes to these Terms

We may update these Terms when the service, law or our business operations change.

Material changes will apply prospectively unless law requires otherwise.

The Terms applicable to an existing transaction will not be rewritten retrospectively merely to remove rights that existed when the transaction was concluded.

The current version and effective date will be displayed on the website.

Where appropriate, we may require users to accept materially updated Terms before making a new purchase or using materially changed functionality.

25. Governing law

These Terms are governed by the laws of the Republic of South Africa.

Any choice of South African law does not remove consumer protections that apply irrespective of a contractual choice of law.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision should be interpreted or limited to the extent reasonably necessary to make it lawful where possible.

The remaining lawful provisions continue to apply.

27. Entire agreement

These Terms, the applicable package information presented at purchase, the Privacy Notice and any other terms expressly incorporated into the transaction constitute the agreement relating to the MomentDrops service purchased by you.

Nothing in this clause excludes any representation, obligation or consumer protection that the law does not permit us to exclude.
